These Terms and Conditions govern the purchase and use of products sold through the official BARITON INC website. By placing an order through our website, you agree to the following terms and conditions.
1. Product Use & Safety
BARITON products are intended for household use unless otherwise specified. Customers are responsible for reading and following all instructions, safety warnings, and operating guidelines provided with the product.
BARITON INC is not responsible for damage or injury resulting from misuse, improper installation, failure to follow operating instructions, unauthorized modification, or use of the product for purposes other than those for which it was designed.
2. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, pricing, and other information displayed on our website are accurate. Minor variations in appearance, colour, packaging, or specifications may occur where they do not materially affect the product’s intended function.
BARITON INC reserves the right to correct errors or inaccuracies and to update product information when necessary.
3. Orders & Acceptance
All orders are subject to availability and acceptance by BARITON INC.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of pricing or listing errors, suspected fraud, payment issues, product unavailability, or other circumstances affecting our ability to fulfill the order.
If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
4. Pricing & Payment
Prices are displayed in the currency indicated on the website, and applicable taxes will be calculated where required.
Payment must be successfully authorized before an order is processed. BARITON INC reserves the right to correct obvious pricing or payment errors.
5. Shipping & Delivery
Delivery estimates are provided in good faith but are not guaranteed unless expressly stated otherwise.
Delivery times may be affected by carriers, weather, customs, incorrect delivery information, or other circumstances beyond our reasonable control.
Customers are responsible for providing complete and accurate shipping information when placing an order.
6. Returns & Refunds
Returns and refunds are governed by BARITON INC’s Refund & Returns Policy.
Eligible unused products may generally be returned within 30 days from the date of purchase, subject to the conditions, exclusions, return shipping costs, and applicable restocking fees described in that policy.
Customers must obtain any required return authorization before returning a product.
7. Limited Warranty
BARITON products are covered by an applicable one-year limited warranty against manufacturing defects, beginning from the original date of purchase.
Warranty coverage requires valid proof of purchase and applies only to eligible products purchased through BARITON INC or an authorized seller.
The warranty does not cover damage resulting from misuse, accident, improper maintenance, unauthorized repair or modification, normal wear and tear, or failure to follow the product instructions.
Warranty service may include inspection, repair, replacement of defective parts, replacement of the product, or another appropriate remedy, depending on the circumstances and subject to applicable law.
8. Defective or Damaged Products
If a product arrives defective or damaged, customers should notify BARITON INC within 7 business days of receipt so that the issue can be promptly reviewed.
This notification period relates to defects or damage identified upon delivery and does not limit the applicable one-year limited warranty or any rights that cannot be excluded under applicable law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, BARITON INC will not be liable for indirect, incidental, special, or consequential losses arising from the use or inability to use a product.
Nothing in these Terms and Conditions excludes or limits any liability or consumer right that cannot legally be excluded or limited.
10. Unauthorized Resale
Products purchased from unauthorized third-party sellers may not qualify for BARITON INC return, refund, or warranty services unless otherwise required by applicable law.
Customers are encouraged to retain their original proof of purchase for warranty and after-sales support.
11. Intellectual Property
The BARITON name, trademarks, logos, product materials, website content, graphics, images, and other proprietary materials are owned by or licensed to BARITON INC and may not be copied, reproduced, distributed, or commercially used without authorization, except as permitted by law.
12. Changes to These Terms
BARITON INC may update these Terms and Conditions from time to time. Changes will apply from the date the updated Terms and Conditions are published on the website and will not retroactively alter completed transactions except where permitted or required by law.
13. Governing Law
These Terms and Conditions are governed by the applicable laws of the Province of Ontario and the federal laws of Canada applicable therein, subject to any mandatory consumer protection rights that may apply.
